    As far as I know, there are no penalties for backstabbing, regardless of what armour, weapon or skills your assassin has.

    The only thing that affects it is the chars level (an assassin peaks at x7 at lvl 21, while all other thief chars top out at x5, except the Swash of course) and the roll o' tha dice. Of course, your weapon(s) will affect the damage, and you can't backstab with weapons that a single-class thief can't use and that isn't melee (flails, two-handed swords, xbows, etc.). Also, you can't backstab if you're not behind your opponent, like Eric Xanthus said.
