I mean, "if you do not get caught, is there any consequence to taking his stuff?"

What if you kill him? Besides the Reputation penalty, are there any consequences?

    No and No.
Atleast that is how it´s been for me.
Depending on your current rep you loose some, but other than that I´ve had no problems. Besides killing him that is.

If you pickpocket him, you get only his +3 scimitar, but if you kill him, you get also his +5 chainmail and +3 scimitar, which gives +2 AC.

Yep, you don't have to worry about consequences. Although if you are paladin or ranger you should beware that your reputation won't drop too much.

There are no consequences for picking his pocket in this game. You can get his +3 scimitar off him which is one of the better weapons in BG1.

What happens if I import my character from BGI into BGII, and I have Drizzt's stuff? Will he come for it then?

    Well, you asked for spoiler...

No, but unless you use a cheat, you won't be keeping it.

You can't import Drizzit's stuff from BG to BGII. In fact, the only importable item is the pantaloons ;)

I've read (in quite a few places) a minor cheat that lets you import your equipment into BGII. You don't even need a cheat code.

I'm playing a character in BGI right now, and I plan to play him all the way through ToB. I'm just doing a little planning, but I haven't decided if I should import his stuff.

Actually last time I pickpocketed drizzt and used his sword in the final fight against Sarevok, the time the last save was made. I imported that save game in BGII and when I encountered drizzt he was pretty pissed of that I stole his sword, you can talk him out of attacking you but there are indeed consequenses, in the form of dialogue.

In my version of BG1, you can pickpocket the +5 defender as well.
But using Drizzt items is somewhat cheesy.
    Spoiler:

In BG2, if you didn't kill him, Drizzt doen't remember you, it doesn't matter if you robbed him or not. If you did, he'll insult you.

In my version it's also possibile to steal the Deffender. The chance is about 1:5. The +3 is much more likely.

The funny thing is that even though you steal one of his swords (if you steal it without killing him) his avatar still has a scimitar in each hand.
