Prosecutor Awarded Over $2 Million After Being Denied Judgeship For Being White

    One for Snook: The Missouri Supreme Court has handed down an important ruling [PDF] on reverse discrimination — upholding an award of more than $2 million for a white prosecutor, Melissa Howard, who was denied a judgeship in 2006 because the Kansas City Council wanted a minority in the position. How nutty is that?

    So let me get this straight - there was a commission set up for the purpose of nominating people who they felt were the best qualified to fill a vacant judgeship. (As an aside, I didn't know "judgeship" was a word, but whatever.) Anyway, the commission passes on its recommendation to the city council, and they said they didn't like those nominated because the three happened to all be white women? Really? WTF?

    I, like Snook, believe that the position should be filled based on merit. But I would also add that the commission did, in fact, nominate non-traditional candidates to begin with. Maybe I'm the only person that has noticed, but in my experience, judges tend to be white, but they also tend to be men. (I'm unsure why this is, as there is no apparent shortage of well-established women lawyers, and that's the pool from which judges are usually selected.)

    So to me, this woman may have a legitimate beef. If she and the others were more qualified than the minority candidates (assuming, of course, there was no racial bias on the part of the commission), why shouldn't she get the job?

    I just completed my civic duty last week and the judge in the case was an old Spanish dude I think. At least some hispanic origin. The guy was great; very understanding and considerate to the jurors, added plenty of interest and humor and was exceedingly patient and kind. He actually made the experience enjoyable.
