It's a pretty fine line between torture and interrogation, at least to some people. The whole use of "cruel and unusual" as a touchstone for determining the ethical acceptability of a certain technique is, IMHO, far too ambiguous. There are people who, for instance, claim that solitary confinement is cruel and unusual -- I say for a murderer or rapist they should thank their lucky stars that they are still alive to BE solitary. the same thing goes for life sentences -- a bunch of bleeding hearts say "yes, he deprived 20 people of their lives, but if we lock him up it wouldn't be fair to him -- we should just ask him nicely not to kill any more people, and that will solve the problem." Makes me sick.

That said, some things are torture in any book -- these things usually involve hot pokers, strategically attached electrodes, physical beatings delivered at random, etc. No civilized society should engage in these acts, and if the U.S. is so doing and hiding behind a shield of "whose side are you on" then I hope the perpetrators of such debauchery are found and punished.

According to the German journal Handelsblatt, CIA prisons in Poland and Romania have been confirmed and there are more in other European countries. "Black sites", so called.

Yeah, it's a bit of a stretch to imagine CIA confirming a secret prison.
