Is it legal to download games that aren't available for purchase?

    Sorry to "Necro" this thread, but I have a question on say downloading the Macintosh version of the Gold Box games.

    I have legal copies of the old Apple II version of the few Gold Box games that were released for that platform. However, I retired my Apple IIGS to a storage box in the basement to make room for more modern computers.

    I ask this, because around 20 years ago I purchased a copy of Might and Magic II in the bargain bin of a local software store. However instead of the two 720K double-density disks that was written on the specs in the box, I found a single 1440K high density disk.
    At the time, I did not have a high density drive, and wouldn't obtain one for several more years. My 3.5" drive could not read the disk.
    I called the company to ask if they could exchange the disk for either the 3.5 720k disks or the Apple II 5.25" disks, and they told me they stopped making that product the year before, and that they were out of stock for replacement media. They told me to ask around any local user groups (no internet back then, and On-Line servies were not nearly as popular back then) and see if anyone has a version I can use, and copy it.
    This was from the customer service rep at New World Computing that basically told me to pirate it.

    Not quite, because you already bought the game legally. There's a world of difference between buying a game and having to jump through potentially illegal hoops to play it and not buying the game at all and only pirating it.
